Preppr - Terms of Service

Welcome to Preppr, an AI-powered job interview practice platform provided by VMGM Software LLC ("Company", "we", "us", or "our"). By downloading, installing, accessing, or using the Preppr mobile application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Preppr.
IMPORTANT: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN SECTION 20.
1. Acceptance of Terms & Eligibility
1.1 Age Requirements
- You must be at least 18 years old to use Preppr.
- If you are between 13-17 years old, you may only use Preppr with parental consent and supervision.
- We do not knowingly collect information from children under 13. If we discover such collection, we will immediately delete the information.
1.2 Capacity
- By using the App, you represent that you have the legal capacity to enter into a binding agreement.
- If using on behalf of an organization, you warrant you have authority to bind that organization.
1.3 Compliance
- You must comply with all applicable local, state, national, and international laws and regulations.
- You are responsible for ensuring Preppr's use is legal in your jurisdiction.
2. Description of Service
2.1 Core Features
Preppr provides AI-powered interview practice tools, including:
- AI voice agents conducting realistic mock interviews
- Real-time conversational practice with natural language processing
- Performance analytics and improvement metrics
- Industry-specific interview question libraries
- Voice recording, playback, and analysis features
- Personalized coaching and feedback powered by machine learning
- Resume parsing and tailored question generation
- Video interview practice capabilities (where available)
2.2 Service Limitations
- Preppr is an educational tool for practice purposes only
- We do not guarantee job placement, interview success, or employment outcomes
- AI-generated feedback is not a substitute for professional career counseling
- Service availability may vary by region and device capabilities
- Some features require internet connectivity and may consume data
2.3 Beta Features
- We may offer beta features marked as "Beta", "Preview", or "Early Access"
- Beta features are provided as-is without warranties
- We may modify or discontinue beta features without notice
3. Mobile App Specific Terms
3.1 App Store Terms
- Your use is also subject to Apple App Store or Google Play Store terms
- In case of conflict, app store terms prevail for app store-related matters
- You must comply with app store guidelines and policies
3.2 Updates
- We may provide updates containing bug fixes, enhancements, or new features
- Some updates may be mandatory for continued use
- Automatic updates may be enabled by default
- You consent to automatic downloads and installations of updates
3.3 Device Permissions
The App may request access to:
- Microphone: Required for voice interview practice
- Camera: For video interview practice (optional)
- Storage: To save practice sessions locally
- Network: For AI processing and content delivery
- Notifications: For practice reminders and updates
You can manage permissions through your device settings.
4. Account Registration & Security
4.1 Account Creation
- Accurate, complete, and current information is required
- One account per person unless otherwise authorized
- You must maintain account information accuracy
- False information may result in termination
4.2 Account Security
- You are responsible for account security
- Keep credentials confidential
- Notify us immediately of unauthorized access at hello@vmgmsoftware.com
- We are not liable for losses from unauthorized account use
- Enable two-factor authentication when available
4.3 Account Termination
- You may delete your account at any time through settings
- We may suspend/terminate accounts violating these Terms
- Termination does not relieve prior obligations
5. User Conduct & Prohibited Uses
5.1 You agree NOT to:
- Violate any laws or regulations
- Use Preppr for commercial purposes without authorization
- Share, sell, or distribute account access
- Reverse engineer, decompile, or hack our systems
- Use automated systems (bots, scrapers) without permission
- Impersonate others or provide false information
- Upload malicious code or viruses
- Harass, threaten, or harm other users
- Post discriminatory, offensive, or inappropriate content
- Circumvent security features or access restrictions
- Interfere with service operation or infrastructure
- Use the service to develop competing products
- Violate third-party intellectual property rights
- Engage in any activity that could damage our reputation
5.2 Content Standards
All user content must be:
- Legal and non-infringing
- Professional and appropriate for job interview context
- Free from hate speech, discrimination, or harassment
- Respectful of privacy rights
6. Voice Recording & Biometric Data
6.1 Voice Data Collection
By using voice features, you acknowledge:
- Voice recordings are captured during practice sessions
- Voice characteristics may be analyzed for feedback
- Recordings are processed using AI/ML technologies
- Voice data may be temporarily stored for processing
- You have the right to review and delete recordings
6.2 Biometric Information
- Voice patterns may constitute biometric data in some jurisdictions
- We process biometric data only with your explicit consent
- Biometric data is encrypted and secured
- You can opt-out of biometric processing in settings
- We comply with applicable biometric privacy laws (BIPA, etc.)
6.3 Consent & Rights
You explicitly consent to:
- Recording and processing of your voice
- AI analysis of speech patterns and content
- Storage of recordings for service improvement
- Use of anonymized data for ML model training
You may withdraw consent at any time, which may limit functionality.
7. Artificial Intelligence & Machine Learning
7.1 AI Disclaimer
- AI responses are algorithmically generated and may contain errors
- AI cannot replace human judgment or professional advice
- We do not guarantee AI accuracy or suitability
- AI has no actual knowledge of specific employer preferences
- Results may vary based on input quality and clarity
7.2 AI Training & Improvement
- We may use anonymized, aggregated data to improve AI models
- You can opt-out of contributing to AI training in settings
- Personal information is not used in public AI models
- We implement bias detection and mitigation measures
7.3 AI Limitations
- AI may not understand context, sarcasm, or cultural nuances
- Responses are based on patterns, not genuine understanding
- AI cannot provide legal, medical, or professional advice
- Technical limitations may affect response quality
8. Payment Terms & Subscriptions
8.1 Subscription Plans
- Free tier with limited features
- Premium subscriptions with full access
- Enterprise plans for organizations
- Pricing displayed in app before purchase
8.2 Billing
- Payments processed through app store payment systems
- Subscriptions auto-renew unless cancelled
- Renewal charges occur 24 hours before period end
- Price changes with 30-day advance notice
- Taxes additional where applicable
8.3 Refunds
- App store refund policies apply
- No refunds for partial subscription periods
- Refunds at our discretion for technical issues
- Promotional offers non-refundable
8.4 Free Trials

- Automatic conversion to paid unless cancelled

9. Intellectual Property Rights

- No compensation for feedback provided
- We may implement suggestions without attribution
10. Privacy & Data Protection

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY
- UNINTERRUPTED OR ERROR-FREE OPERATION
12.2 No Professional Advice
- Preppr does not provide career counseling
- Not a substitute for professional services
- No guarantee of employment outcomes

12.3 Technology Limitations
- Service dependent on internet connectivity
- Device compatibility may vary
- Features may not work in all regions
- Technical issues may occur
13. Limitation of Liability
13.1 Damages Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Not liable for lost profits, data, or opportunities
- Not liable for service interruptions or errors
- Total liability limited to amount paid in past 12 months or $100, whichever is greater
13.2 Exclusions

Limitations apply even if remedy fails essential purpose.
14. Indemnification
You agree to indemnify, defend, and hold harmless VMGM Software LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another
- Your content or data
- Your breach of applicable laws
- Your negligence or willful misconduct
15. Term & Termination
15.1 Term

- Uninstall app from device

- Immediate termination for Terms violations
- 30-day notice for convenience termination

16. Modifications to Service & Terms

20. Dispute Resolution & Arbitration

20.2 Binding Arbitration
- Disputes resolved through binding arbitration

- Single arbitrator proceedings

- Each party bears own costs
20.3 Class Action Waiver
YOU WAIVE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. DISPUTES MUST BE BROUGHT INDIVIDUALLY.
20.4 Exceptions

21. Severability
